General terms and conditions of sale
1 - SCOPE OF APPLICATION
These general terms and conditions of sale apply to any consultation or order placed on the website www.heuforia.com owned by Crisbo Srl (hereinafter HEUFORIA) for the purchase of goods to be delivered in Italy (hereinafter the Products). Confirmation of the order by the purchaser implies unconditional acceptance of these general terms and conditions of sale, which prevail over all previous or specific versions generated by the purchaser, including the exchange of email messages.
2 – ORDERS
2.1 Product offer
The essential characteristics and prices of the products are shown in the offer relating to each individual product on the site.
To purchase the products, the Customer must complete and send the purchase order form in electronic format, following the instructions contained on the site.
The Customer must place the product in the appropriate cart and, after viewing and accepting the contribution for delivery costs, as well as the General Conditions, the Privacy Policy and the conditions on the right of withdrawal, must select the desired payment type and choose the “submit order” option.
Orders may be placed after registration and creation of a personal customer account, as per the previous paragraphs, by following the steps and instructions specified on the Site itself.
2.2 Order acceptance
For the purchaser, the order shall be considered concluded when the entire purchase procedure has been completed regularly and correctly, without any error being highlighted by the site. HEUFORIA is not responsible for malfunctions dependent on the data transmission network operator. By sending the order, the Customer acknowledges and declares that they have read all the information provided during the purchase procedure and fully accept the general conditions.
The purchase order form will be stored in the site's database for the period of time necessary to process the orders. The staff will send the Customer, by email, a confirmation of receipt of the purchase order, containing the essential characteristics of the purchased Products, the date the order was placed, the detailed indication of the price, the payment method chosen by the Customer, and the delivery costs. The Customer is required to verify the content of the communication and immediately report any errors or omissions.
2.3 Minimum order
HEUFORIA does not set a minimum order amount.
3 - PRICE / PAYMENT
3.1 Product price
Product prices are indicated in Euro and include all taxes or duties applicable to the sale of the products
3.2 Delivery costs
HEUFORIA shipping rates are not included in the price of each item. This allows us to offer tailored rates depending on the purchase, while remaining transparent about the real value of our products.
Shipping costs for Italy amount to € 6,00 for each package.
3.3 Payment
Payment, made exclusively in euros and in full at the time of the order, unless otherwise indicated at the time of the order, must be made via PayPal or credit card.
As part of its fight against internet fraud, HEUFORIA may be required to verify the bank details and/or identity of customers before each delivery. By placing an order on the internet, the customer undertakes to provide HEUFORIA with the requested information. If the information requested by HEUFORIA is not provided within the established deadline, HEUFORIA reserves the right to cancel the order that is subject to verification.
Since orders are taken into consideration exclusively after confirmation of payment received, it will not be possible to apply discounts or penalties for delays.
Payment with PayPal
PayPal is a secure payment method that allows you to pay quickly for your items without sharing your bank details with merchant websites. It is sufficient to have provided such details when creating your PayPal account. At that point they are encrypted and secured once and for all.
If you already have a PayPal account, you can use it on our site to pay for your purchases quickly and securely.
If you do not have a PayPal account, you can still choose this payment method. At the time of payment, you will be redirected to a PayPal page where you will need to enter your details and choose whether or not to create a PayPal account.
3.4 Invoicing
The invoice addressed to the customer contains the information provided by the latter in their customer account. The customer may modify the data with each new order submitted on the site.
The invoice is issued only upon specific request by the customer at the time of the order: mail-order sales are not subject to the obligation of certification by issuing an invoice (art.22 paragraph 1 DPR 633/72) nor to the obligation of certification by issuing a receipt or sales slip (art. 2 DPR 696/1996).
4.1. DELIVERY METHODS
Shipments are made by GLS courier.
Deliveries are made with the SMART DELIVERY SERVICE or with the FLEX DELIVERY service depending on the destination area. Through a link sent by email, the customer can access a management area both before and after the delivery attempt and choose various customizations:
- Change the expected delivery date
- Choose a collection point between the GLS branch and GLS Parcel Shop
Or
- Indicate an alternative delivery address
- Indicate a safe place for delivery
- Authorize delivery to a neighbor
- Refuse delivery
Orders are processed and delivered from Monday to Friday. Packages are shipped immediately after receipt of the amount due via Paypal or credit card. Should delays occur, the customer will be promptly informed

4.2 RETURNS MANAGEMENT
Returning or replacing a product purchased on the website www.heuforia.com is always possible and very simple.
According to Legislative Decree 206/05, the customer may exercise the right of withdrawal within 20 (twenty) working days from the moment of receipt of the goods, without any penalty. In this case it is necessary to send an email to info@heuforia.com. The goods must be returned in the original box to: HEUFORIA, Via Enrico Fermi 16 - 46013 Canneto Sull’Oglio MN, with a written communication containing the declaration of intent to make use of the right of withdrawal pursuant to art.64 of Legislative Decree 206/2005, the indication of the products for which the customer wishes to make use of the right of withdrawal, and the progressive order number issued at the time of purchase.
In the event of return of tampered with or non-intact products, management reserves the right not to accept the package and to send it back to the sender charging them the transport costs incurred. HEUFORIA reserves the right to replace the product by including it in a subsequent customer order or to refund the amount paid by the customer at the time of the order.
Delivery costs for returning products are borne by the Customer; any cost incurred by the Customer for redelivery will not be refundable.
5 - PROMOTIONS
HEUFORIA reserves the right to create special sales conditions or promotions on the products present on its site. The conditions applied to promotions will be governed from time to time by specific communications to its Customers.
For anything not otherwise regulated, these General Conditions shall be deemed applicable.
6 – USE OF THE WEBSITE AND PRIVACY
6.1 Intellectual property
The elements published on the HEUFORIA website, including, in particular, the logo, registered trademarks, texts, photographs, images, drawings, models or tables, constitute works protected by intellectual property rights or personal rights. The reproduction or representation, in whole or in part, of this site is therefore prohibited without the prior and express agreement of the holders of such rights and may constitute an act of counterfeiting sanctioned by the provisions of the Intellectual Property Code and/or a criminal offense such as to imply the civil liability of the infringers of the aforementioned rights.
6.2 User responsibility
Responsibility for browsing the website www.heuforia.com is entirely borne by the user. HEUFORIA cannot be held responsible for failures, errors or computer viruses that could hinder continuity of access to its site or for malfunctions that may be found on users' PCs following access to the site

6.3 Registration
To complete a purchase on the Site it is mandatory to be registered.
The Site registration procedure requires the completion of an electronic form, the fields of which must be filled in with the Customer's personal data and email address. Such data will be processed in accordance with the current privacy protection legislation. Following registration, the Customer will hold a personal account which may be accessed through a username and a strictly confidential access password. The assignment of these credentials guarantees the Customer anonymous identification. It is the Customer's responsibility not to disclose their password to third parties for any reason. The Customer shall be held responsible for any actions and irregular conduct in breach of the regulations in force or these General Conditions committed by anyone using the personal account on their behalf. 6.4 Privacy
HEUFORIA collects the buyer's personal data necessary for registration and order processing and/or to respond to requests for information. In accordance with privacy law, the buyer has the right to access, rectify, object to and delete their personal data. For any information, contact info@heuforia.com

The Customer is required to carefully read the following information concerning privacy protection: the rules governing the Site's privacy policy are applied whenever a Customer accesses the Site and decides to browse within it and use the services offered, regardless of the purchase of products. The privacy policy of the site www.heuforia.com complies with the notice pursuant to art. 13 of Legislative Decree 196/2003, called the “Personal Data Protection Code” concerning users who access the Site and interact with the web services, as amended by EU Regulation 2016/679 (GDPR)
The data controller is CRISBO S.r.l., with registered office at Via Galileo Galilei 35, 46013 Canneto Sull’Oglio (MN).
In particular, the processed data may be used:
a) for purposes connected with legal obligations or provided for by regulations and Community legislation as well as by provisions issued by authorities and therefore legitimized by law;
b) for the purchase of Products through the appropriate order form;
c) for order fulfillment;
d) to provide assistance and customer care services;
e) for registration on the Site, through the relevant registration form, to provide access services to reserved areas;
f) for purposes functional to e-commerce activity, for which the Customer shall have the right to give or deny consent to processing, including, for example: sending advertising material, news, use of data for statistical purposes, and for the creation of consumer profiles.
In relation to the purposes indicated above, processing takes place through appointed persons and by means of IT and telematic tools, with software processing and data storage in databases. The processing methods are all based on criteria and principles strictly connected and related to the purposes themselves and, in any case, capable of ensuring the confidentiality and security of the data themselves.
Mandatory or optional nature of the requested information and collected data
The Customer's personal data are requested and collected, and their provision is mandatory for the purposes indicated in letters a), b), c), d) and e). In such case, refusal of consent will not allow the conclusion of the contract or the fulfillment by HEUFORIA of the Customer's requests regarding the available services. Failure to provide consent to the processing of optional data and for the purposes referred to in letter f) shall not entail any prejudicial consequence.
Subjects and categories of subjects to whom the data may be communicated:
For the fulfillment of the contractual obligations undertaken, as well as for the performance of the services provided, HEUFORIA also makes use of the collaboration of external companies that carry out activities strictly connected and instrumental to the performance and execution of the concluded contracts and services rendered such as, for example: transport companies and freight forwarders with regard to the delivery of goods and customs formalities, banking institutions for the management of collections and payments, financial administrations and other bodies in compliance with regulatory obligations, companies and law firms for the protection of rights relating to contractual relationships, self-employed professionals for administrative-accounting obligations, postal services, companies connected to the controller for market analysis purposes, Marketing and communication activities.
The processing of data by these subjects is therefore aimed at implementing the provisions received from customers and/or storage on IT media. The data may also be communicated to all subjects to whom communication is due by reason of legal obligations.
Customer Rights
In accordance with Art. 7 of Legislative Decree 196/2003, the Customer has the right to access the following information:
1. Confirmation of the existence or otherwise of personal data concerning them, even if not yet recorded, and communication thereof in intelligible form.
2. indication of:
a) the origin of the personal data;
b) the purposes and methods of processing;
c) the policy applied in the event of processing carried out with the aid of electronic instruments;
d) the identification details of the controller, the processors and the representative designated pursuant to Art. 5, paragraph 2;
e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representative in the territory of the State, processors or persons in charge.
3. The data subject has the right to obtain:
a) the updating, rectification or, where interested therein, integration of the data;
b) the deletion, transformation into anonymous form or blocking of data processed in violation of law, including those for which retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
c) certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case where such fulfillment proves impossible or involves the use of means manifestly disproportionate to the protected right.
4. The data subject has the right to object, in whole or in part:
a) for legitimate reasons to the processing of personal data concerning them, even if pertinent to the purpose of collection;
b) to the processing of personal data concerning them for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.
7 CHANGES TO ORDERS
If the Customer wishes to modify or cancel the submitted order, they must send an email to info@heuforia.com. The staff will do everything possible to satisfy the Customer's request. However, once the product has been shipped, the order may not be canceled or modified until the shipped goods have been returned to the registered office. In such case, reference is made to the procedure described in the previous paragraphs.
8 ERRORS AND INACCURACIES
HEUFORIA aims to provide constantly updated information on the Site.
However, it is not possible to guarantee that the Site is completely free of any errors; it may contain typing errors, errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the Product information sheet itself.
HEUFORIA reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted and also reserves the right to change or update information at any time without prior notice.
9 DISPUTES
In the event that disputes arise concerning the interpretation and execution of these general conditions of sale between HEUFORIA and Customers, such disputes are referred to the exclusive jurisdiction of the court of the place of residence or domicile of the consumer.

11 – MISCELLANEOUS
11.1 Partial invalidity
If one or more clauses of these general conditions of sale are considered null and void or declared as such in application of a law, regulation or following a final decision of a competent jurisdiction, the other clauses shall retain their full force and scope.
11.2 Entire agreement
These general conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entirety of the contractual relations between the parties.
12- APPLICABLE LAW / JURISDICTION
Relations between buyers and HEUFORIA, relating to orders submitted on the Site, shall be subject to Italian law, without prejudice to the mandatory provisions of the law of the consumer's place of residence.
